1. Agreement to Terms

By accessing or using StoreAsk ("the Service"), operated at storeask.co, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

StoreAsk is a plain-English analytics platform for Shopify store owners. The Service allows you to connect your Shopify store and ask questions about your store data in natural language. StoreAsk retrieves and analyzes your store data through the Shopify API to provide answers, insights, and recommendations. The Service accesses your store data using read-only permissions and does not modify your store in any way.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Subscription and Billing

Some parts of the Service are billed on a subscription basis ("Subscription"). You will be billed in advance on a recurring monthly basis. Subscription fees are non-refundable except as required by law or as explicitly stated in these Terms.

Free Trial: We may offer a 14-day free trial for new users. At the end of the free trial period, your subscription will automatically begin unless you cancel before the trial expires. You will not be charged during the free trial period.

Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, your access to paid features will continue until the end of your current billing period. After that, your account will revert to limited access. You may request deletion of all your data at any time.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Transmit any malicious code, viruses, or harmful data
• Attempt to gain unauthorized access to the Service or its related systems
• Use the Service to compete with StoreAsk or to build a similar product
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with unauthorized third parties
• Use automated systems (bots, scrapers) to access the Service without our written permission

6. Shopify Store Data

By connecting your Shopify store to StoreAsk, you authorize us to access your store data through the Shopify API using read-only permissions. You represent and warrant that you have the authority to grant this access and that doing so does not violate any agreement you have with Shopify or any third party.

You retain all ownership rights to your store data. We do not claim any ownership over your data. We use your data solely to provide the Service to you. We will not sell, share, or distribute your store data to any third party. You may revoke access to your store data at any time by disconnecting your store from StoreAsk or by deleting your account.

7. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of StoreAsk and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of StoreAsk.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied. StoreAsk does not warrant that the Service will be uninterrupted, timely, secure, or error-free. The insights and recommendations provided by StoreAsk are for informational purposes only and should not be considered as professional business, financial, or legal advice. You are solely responsible for any business decisions you make based on information provided by the Service.

9. Limitation of Liability

In no event shall StoreAsk, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service. Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless StoreAsk and its licensees and licensors, and their employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt and expenses (including but not limited to attorney's fees) arising from your use of and access to the Service, or your violation of these Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
